Terms and Conditions

1. About these terms

These terms and conditions ("Terms") govern your access to and use of the website at cairnstonegroup.net and any sub-domains operated by us (the "Website"). By accessing or using the Website you agree to be bound by these Terms. If you do not accept these Terms, you must not use the Website.

These Terms do not govern the provision of any consulting, advisory or other professional services by us. Such services are provided only under a separate written engagement letter or contract entered into with the relevant client, and the terms of that engagement (and not these Terms) will determine the rights, obligations and liabilities of the parties in respect of those services.

2. About us

The Website is operated by Cairnstone Group Limited ("Cairnstone", "we", "us" or "our"), a company registered in England and Wales under company number 16805685, with its registered office at 33 Hill Street, London W1J 5LT, United Kingdom.

You can contact us at adunkels@cairnstonegroup.net.

3. Changes to these Terms

We may revise these Terms from time to time by updating this page. The version in force at the time you access the Website applies to your use of it. We recommend that you review these Terms periodically, and the date at the top indicates when they were last updated.

4. Accessing the Website

The Website is provided on an "as is" and "as available" basis. We do not guarantee that the Website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw, or restrict the availability of all or any part of the Website for business or operational reasons, without notice.

You are responsible for making all arrangements necessary for you to access the Website, and for ensuring that all persons who access the Website through your internet connection are aware of these Terms and other applicable terms, and comply with them.

5. Intellectual property

The Website and all content published on it — including but not ltrademarktext, commentary, articles, insights, analysis, photographs, images, graphics, logos, design elements, layout, and the selection and arrangement of the foregoing (together, the "Content") — are owned by Cairnstone or licensed to us, and are protected by copyright, trademark, database right and other intellectual property laws and treaties around the world. All such rights are reserved.

The name "Cairnstone", Cairnstone Group, the Cairnstone logo, and any associated marks, slogans, or designs are trademarks of Cairnstone Group Limited. You may not use them without our prior written permission.

You may view, download for caching purposes only, and print pages from the Website for your own personal, non-commercial use, subject to the restrictions set out in these Terms.

6. Restrictions on use

You must not use the Website, or any Content on it, in any way that is unlawful or that would infringe the rights of any other person. In particular, you must not, without our prior written consent:

(a) reproduce, copy, republish, distribute, transmit, broadcast, sell, license or otherwise exploit any Content for commercial purposes;

(b) modify, adapt, translate, reverse engineer, or create derivative works based on the Website or any Content;

(c) systematically extract, scrape, harvest, mine, index, or otherwise collect data from the Website (whether by manual or automated means), including for the purpose of training, fine-tuning, or developing any artificial intelligence, machine learning, or large language model;

(d) frame, mirror, or otherwise incorporate the Website or any Content into any other website, application, or service;

(e) remove or alter any copyright, trademark or other proprietary notices on the Website or in any Content;

(f) use the Website in any manner that could damage, disable, overburden or impair the Website or interfere with any other user’s use of it;

(g) attempt to gain unauthorised access to the Website, the server on which it is stored, or any server, computer or database connected to the Website;

(h) introduce any virus, trojan, worm, logic bomb or other material that is malicious or technologically harmful; or

(i) use the Website to publish, transmit, or otherwise make available any unlawful, defamatory, harassing, threatening, or otherwise objectionable content.

We may, at our discretion, take such action as we consider appropriate in response to any breach of this clause 6, including suspending or terminating your access to the Website and reporting the matter to the relevant authorities.

7. Information on the Website is not advice

The Content is provided for general information about Cairnstone and our work only. It is not intended to amount to professional, legal, financial or other advice on which you should rely. You should obtain specific professional advice before taking, or refraining from, any action on the basis of any Content on the Website.

While we make reasonable efforts to ensure that the Content is accurate and up to date, we make no representations, warranties, or guarantees, whether express or implied, that the Content is accurate, complete, current, or free from error or omission.

8. Third-party links

The Website may contain links to third-party websites and resources. These links are provided for your convenience only. We have no control over the content of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of any link does not imply endorsement by us of the linked site or its operators.

9. Limitation of liability

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be excluded or limited.

Subject to that:

(a) we exclude all conditions, warranties, representations, and other terms which might otherwise be implied by statute, common law, or the law of equity in relation to your use of the Website;

(b) we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with your use of, or inability to use, the Website or any Content on it; and

(c) in particular, we will not be liable for any: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect or consequential loss or damage.

For the avoidance of doubt, this clause 9 applies only to your use of the Website. The liability of Cairnstone in respect of any consulting, advisory, or other professional services provided to a client is governed exclusively by the engagement letter or contract entered into between Cairnstone and that client, and not by these Terms.

10. Privacy

Our collection and use of personal data through the Website is governed by our Privacy Policy, which forms part of these Terms.

11. Complaints

If you have a complaint about the Website or any Content on it, please contact us at adunkels@cairnstonegroup.net with a clear description of your complaint and any relevant supporting information. We aim to acknowledge complaints within five working days of receipt and to provide a substantive response within twenty working days. Where a complaint requires further investigation, we will keep you informed of progress and the expected timescale for resolution.

12. Governing law and jurisdiction

These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or your use of the Website.

13. General

If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Website and supersede any previous agreement between us in relation to your use of the Website.
